These Terms of Use (“Terms”) are an agreement between you and Klorby (“Klorby”, “we”, “us”) about the Klorby mobile app (the “App”) and klorby.com (the “Website”). Our Privacy Policy explains how we handle information.
1. Your license
We give you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial use, as allowed by the App Store or Google Play rules. You may not copy, resell, reverse-engineer or redistribute the App, except where the law allows it anyway.
2. Klorby Pro
- Klorby Pro is a one-time purchase. It is not a subscription and never renews.
- The price is shown in the App before you buy and may vary by country, taxes and store promotions.
- Purchases are processed by Apple or Google under their terms. Refunds are handled by them: see Apple’s or Google Play’s refund process.
- Pro is tied to your App Store or Google Play account. Tap Restore on the Pro page in the App on a new device.
- We may add, improve or retire individual features over time. We won’t turn a feature you paid for into a subscription.
3. Your content
Your plants, notes and photos are yours. They stay on your device and we don’t get a copy. You are responsible for backing them up: Klorby gives you a backup file tool, but if you lose your phone or delete the App without a backup, we can’t recover your data.
When you share cards, videos or Plant Passports, make sure you have the right to share what’s in them, and be kind. Don’t use Klorby to share anything illegal or hurtful.
4. Plant care, light and pet-safety info
Klorby’s care tips, reminders, Plant ER plans and quiz results are friendly general guidance, not a guarantee. Every plant, home and climate is different, so use your own judgment. 🌱
- Light Map readings are estimates from your phone’s camera or light sensor, shown as simple bands. They are not scientific measurements.
- Pet-safety labels are based on public sources like the ASPCA’s plant lists. They are not veterinary advice. Individual animals can react differently, and plant names can be confusing. If your pet may have eaten a plant, contact your vet or an animal poison control center right away (in the US, ASPCA Animal Poison Control: (888) 426-4435; a fee may apply).
- Klorby is not intended to give advice about human health. Don’t eat houseplants because an app said they were pet-safe.
5. Acceptable use
Please don’t misuse Klorby. For example, don’t:
- try to break, overload or get around the App’s security or purchase checks
- use Klorby’s name, mascot or artwork to suggest you are us or that we endorse you
- create Plant Passports or share cards to mislead or harm others
6. Our stuff
Klorby, the Klorby mascot, artwork, plant voice lines and the App’s design belong to us and are protected by law. You’re welcome to post your own share cards, timelapses and Wrapped videos made with the App, including the Klorby branding on them. That’s what they’re for! #KlorbyGrow
7. Third-party services
The App relies on Apple and Google for downloads and purchases, and on the services described in our Privacy Policy for optional analytics. Their terms apply to their services. The App Store and Google Play are not responsible for the App or for supporting it. We are.
8. Disclaimers
The App and Website are provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We can’t promise the App will be error-free or that every plant will thrive (we really wish we could).
9. Limitation of liability
To the fullest extent allowed by law, Klorby will not be liable for any indirect, incidental, special or consequential damages, or for loss of data, plants or pets’ goodwill, arising from your use of the App. Our total liability for any claim is limited to the amount you paid for the App in the 12 months before the claim. Some places don’t allow these limits, so they may not apply to you.
10. Ending things
You can stop using Klorby anytime by deleting the App. We may suspend access to features if you seriously break these Terms. Sections that by their nature should survive (like ownership, disclaimers and liability limits) will survive.
11. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Nothing here takes away rights you have as a consumer under the laws of where you live.
12. Changes
We may update these Terms. We’ll change the date at the top, and for important changes we’ll let you know in the App. If you keep using Klorby after a change, you accept the new Terms.
